Amid the several aspects of the Supreme Court’s healthcare decision that were 5 votes to 4, there was one issue on which 7 of the 9 judges agreed: Congress unconstitutionally trampled on states’ rights by threatening to withhold Medicaid funding if a state did not follow Washington’s Medicaid directives.
This could be an historic turning point for states’ rights, which have been constantly giving way to growing federal power for decades.
For one thing, states may now opt out of the Medicaid expansion.
For another, this may empower states to push back in court on other federal attempts to buy state compliance through federal funding, whether in K-12 education reform, environmental laws and the like.
In the dark cloud of the healthcare decision, there’s at least one silver lining for the states.
